Mechanic’s Liens

Mechanic’s liens are an important legal right that that a contractor, subcontractor, or material supplier has to secure payment for labor or materials supplied in improving, repairing, or maintaining property.   A mechanic’s lien is a statutory right, which requires a claimant to follow strict guidelines to perfect the lien, generally including filing a Notice of Commencement and/or Preliminary Notice, filing written notice to hold and claim a lien with the County Recorder, and filing an action to foreclose the lien.  Each of these requirements have time limitations, and unless all statutory requirements are met, the lien will not be perfected and unenforceable.  If the lien relates to a residential project, then the claimant must also comply with the Residence Lien Restriction and Lien Recovery Fund Act.
